CL-2018-000631 SDI Retail Services Limited v. The Rangers

 

This one could be interesting.

One this that IS certain, as Mr King himself said that the RIFC AGM late last year, the legal wrangles with Sports Direct are not going to go away.

General Ashley has proved that he has a single-minded determination on these matters ever since the Off Licence Putsch of 2015.

Meanwhile, despite being coveted by the likes of Barca and Sevilla, there are no offers for Alfredo.

I find this baffling given his ability in front of goal and excellent disciplinary record.

ADDENDUM

If this report is true, and there is no reason to doubt it as it is likely to be Press Association (PA) copy, then it is a major win for the Sevco High Command.

Probably their best bit of news since the current regime took over in March 2015.

Of course, the devil will be in the detail and we will have to wait for the full written judgment.

This may just involve the current High Court Injunctions rather than the putative damages for the car boot sale.

If it is just the injunction then it is in the category of the minor victory rather than the game-changer.

Moreover, it would be entirely in keeping with his stance heretofore that Mike Ashley will take this case to the limit of the law, as the report suggests.

Next stop the Court of Appeal?

Here is the judgment.

From my unqualified read it would appear that this is the key element:

12. It follows from the above that Rangers will not be in breach of the Injunction should it seek (whether by court action or otherwise) to recover sums said to be due to it under the Elite/Hummel Agreement. It is, therefore, unnecessary for me to consider the parties’ interesting arguments as to whether the Injunction should be varied.

  1. Thats a belter. Rangers sign superstar Hagi’s son from Genk on loan and he’s been given the same superstar headlines as his dad.
    Not quite sure why he couldn’t get much action at Fiorentina or Genk if he’s that good?

  2. Back to the footie on the park. Even allowing for the quality of opposition Celtic’s first 30 minutes was as good as anything I can remember in recent years.
    It could quite easily have been 5 or 6 at half time.
    Same again on Sunday please.

    • Wouldn’t hold my breath. Couldn’t even manage same again in the second half. Manager got his starting 11 spot on then it was downhill from there. Mikey Johnston is no wonderkid.

      As for second half…??
      Saw it coming…we couldn’t keep that up for 90 minutes…plus the shape got altered drastically…and why..??
      One thing that really annoyed me though….why send Klimala on so late…?? another Lenny puzzler. …being kind !!

      • 100% agree. Klimala needs to get up to speed ASAP in case Eddie or Griff pick up an injury.
        Either one of those two should have been taken off after an hour to give him a half hour run out in my opinion.

        I believe Klimala hadn’t played for a few weeks prior to signing, so surely it was more beneficial to bring him on than Johnson, especially as the game was basically finished as a contest.

    • When Forrest is played in his natural and most effective position on the right wing he can inspire the team as in that first 25 minutes.
      Second half he’s playing on the left and they didn’t come close to scoring.

  3. Its a shade peculiar that the car interference thingy comes up a couple of days before the transfer window closes.
    Is this an opportunity to build a case that the Colombian man child is being hounded out of Glasgow, adding this to the preposterous racist abuse claims made towards Morelos at Celtic Park?
    It says a lot about the alleged car interferer that he could outrun the professional footballer!

    • We do have to admit though it’s a belter of a squirrel story . As they have used all the best teams throughout Europe and the world that have shown an interest in M&M the well is dry on that one .

  4. So wee Coco has said sevco will be forced into a panic signing because of DEFUNCT injury . By the looks of their squad and the players getting papped out of ibrox right left and centre all their team have been panic signings especially Clarke Kent . Oh and they want a million quid for Jones a dont know if that’s Tom or Jordan .

  5. haha – Sevco owed close to 2.5 million by elite/hummel…..thats a dent in the black hole of accounts….obviously that money factored in – now its still to come – i guess they are hurting hard…

  6. As far as legal rulings go, this is a big nothing-burger as far as SD are concerned. The underlying injunction for Rangers not to “assist” Hummel/Elite in performing the contract for the 2020/21 season is still in place. This whole hearing was weather a Rangers could compel Hummel/Elite to pay amounts owed that the original ruling ASSUMED HAD ALREADY BEEN PAID!

    This doesn’t change the injunction regarding the kit sales for next year. Not will it impact the damages owed by Rangers to SD. It just allows Rangers to collect monies from Hummel/Elite that will ultimately be owed to SD as damages when the whole case is finally resolved.

      • Jimbo, you’ve made that assertion a few times here, but that issue was directly addressed in the case last year which was ruled on in SDI’s favor. There is still a damages hearing that has yet to take place precisely BECAUSE judge Percy rejected that argument. Just because the attorneys for Rangers argue that their liability is capped doesn’t make it so. If Percy was inclined to accept that argument, this case would have been settled long ago as the damages owed by Rangers to SD is the only remaining issue left to resolve, and Percy has accepted SD’s claim that the damages inflicted on SD is well in excess of £1M. If he was going to accept that liability is capped at £1M (essentially ruling in Rangers’ favor on this point), he would have awarded monetary damages in the prior ruling. But he did not do so, and the next round of hearings will be to determine not whether £1m is an appropriate award, but exactly how much over that figure is appropriate.

      • Och man stop talking nonsense. Sevconians keep spouting this pish. The judge knocked that one right off the shelf and add that Sevco/Rangers could expect “to pay damages running into many millions of pounds.”

        It’s beyond my understanding why this figure hasn’t been settled on yet.

        But trust me pal. If you think Sevco are going to get off with a million you’re living in cloud cuckoo land.

  7. Disclaimer; I’m not an attorney, but I have many years of experience in the business world with legal contracts and how to interpret them. My reading of the judgement, like yours at end, is that it pertains ONLY to the wording of the Injunction and whether that injunction restricted *Rangers in pursuing monies owed from Elite. The damages bill that SD is asking for probably already includes these amounts, but if not, will be tacked on to what they are asking for.

    However, I will also add that I am not sure it is really a victory for *Rangers, more like a victory for common sense. No Judge is going to restrict a company in litigation, and for which no verdict has yet been reached, from trying to get funds it believes it is owed under a contract. Even if that contract itself is part of the litigation.

    The key part of this ruling, notwithstanding an appeal of it by Ashley’s SD team, is going to come down to 2 issues; 1) whether ELITE will now remit the currently owed funds to *Rangers, or whether they take the view that they will be taking them to court themselves for the money they lose on the contract for the last year, and hold on to it forcing *Rangers to take them to court for it.

    Or issue 2), what happens to the money if Elite does remit the funds due on 2019/2020. Does SD immediately try to ring-fence the monies or does SD hope that they get the damages verdict before Elite pays out the funds and so he would already have moved to ring-fence the monies. A last possibility, not to be overlooked is that SD and Elite could have a “gentlemen’s” agreement for Elite to hold the monies for a while and SD does not go after them for damages?

    My guess is that SD go back to the judge with the question of what happens to any money that *Rangers get as it will have bearing on whether the club would have the ability to pay the verdict the judge has already been calculating.

      • You can keep repeating that nonsense as many times as you want. The judge rejected the cap in last years ruling for Sports Direct. Try reading that ruling and educate yourself a little, instead of listening to wishful nonsense from *Rangers fan sites.

      • Jimbo, I’m paraphrasing here but I recall the Judge stating the relief would run into ‘many millions’. Now, behave yourself with the 1m nonsense.

    • Not sure SD will, or even can go after the money owed to Sevco. The money SD are after is the money that they were unable to make because basically Sevco reneged on the contract by going behind SD’s back and signing the Hummel/Elite contract.. If Sevco were recieving a higher percentage from Hummel and Elite, SD may be able to go after the difference.

      • quick clarification. I wasn’t saying that the Elite money belonged to SD. I meant that when the final damages award figure is announced they will owe Sports Direct some figure in the many millions and SD will want to make sure they can get a hold of that money before pished away. Given the state of that clubs finances, there should be genuine concern by SD as to whether they will ever get whatever damages they are awarded.

      • In that case…is the deal beyween trifc/sevco, not obsolete and non applicable as it was/ is an illegal contract,,,,,,
        After all….trifc did not have an obligation to inform himmel of the deal with sdi to allow himmel/elite to make a deal that could be honoured.
        Im aftaid I would be looking…if I was hummel/elite….to legally nulify the deal die to trifc basically making a deal with me it jad no legal right to do.
        Think i would seek damages also for damages caused by trifc involving me in their fiasco

  8. Lol the people that wear the beanies and the tea-cosy hats are not best pleased about Everton knocking back £85 million quid for their striker Richarlison that they have hardly heard of . Absolute funny money that Barca want to pay for him they are saying . Not a mention in amongst all these comments on their player M&M and all those £30million £50million and even £75million bids they wont accept for him . And they are having the cheek to call out Everton holding out for more cash . You never know Everton might just sell the player to Barca for £85 million quid and give the cash to sevco to replace the player they sold to Barca with M&M.

      • It’s an article about Glasgow Rangers does that do it for you . Don’t want you feeling left out so what do you want to talk about the weather. Sounds like you have been put up to that by another tea-cosy wearing person from the other day . Oh look it’s an article on sevco but don’t comment on it . The stuff from ibrox noise and radio snyde is good to get out there but it seems it’s not everyone’s cup of tea hearing it mmm. Maybe a wee closet hun or 2 nipping into the blog trying angle in on a quiet protest .

  9. It’s already out there that this is a huge Court win for sevco but the only winners in the whole debacle are the lawyers. Big Mike will still be due his money. HH

    • I have said before the damages will be paltry due to the fact that in Ashley’s last two year in contract there was a fan boycott. There is no large loss of money,as if he had matched elites price the fans would just carried on with the boycott.

      • Judgement won’t be based on that. In any case, it was Rangers themselves who were behind the boycott, and SD were able to shift old unsold stock after King gave the go ahead to the support.

  11. If I were at a club interested in taking a punt of the Senor, I would wait until the outcome of the court case. Depending on the severity of the outcome, I might just offer £30 and two nude books.

    • They HOPE they’re going sell him. I actually think he’s a decent enough striker who may do well outside the cess pit of Ibrox and, more widely, Scottish fitba. But he needs a serious sports psychology programme.

  12. Phil – the window hasn’t closed yet… anyway, you can’t just walk into your bank and expect the cashier to have £50 million immediately to hand! There are protocols for getting that amount together!!

    I’m certain that, as we speak, Man United’s bank are waiting for a phone call from the Governor of the Bank of England. Similarly, Juventus, PSG, Barcelona, etc are all pensively waiting that call from their own national treasury, to release funds to pay for this footballing prodigy.

  15. No doubt the disciplinary issue is high on the agenda of prospective suitors.
    The fact that anyone interested and wanting to check on his immediate form will have been disappointed to discover that the ‘torn faced’ Colombian was once again taking a suspension holiday with just a couple of yellow cards on his return to action enough to remove him again from the front line.
    Will today be the end of the road for the Sports Direct farce, a farce of the Rangers executive’s own making?
    Will this put an end to Gerrard’s hopes of making a late addition to his squad or, as in times past, monies will be found from somewhere?
    We wait with bated breath.

  16. We should be hearing about an offer soon from Arsenal regarding M&M as Aubameyang is on his way to Barca . So it looks like Barca have been put off the fee for M&M of £75million quid so says wee Coco at ibrox noise Barca will get Aubameyang for £50 million quid instead . So it looks like Barca are going down the cheap road eh .
