Contempt proceedings against Mr David Cunnigham King

I have written here repeatedly that the Take Over Panel chaps would go about their business quietly and diligently.

They would not proceed with a giddy haste that would satisfy the toddler timescale of a football fan.

Some of the comments posted here questioned the minerals of the Take Over Panel to go after Mr King.

So try this for size:

  1. In the event, process in the contempt proceedings appears to have been served on Mr King in South Africa on 8 June 2018.

However, the main action can be found in paragraphs 18-24.

This entire saga commenced the week after the Off Licence Putsch in March 2015.

Ousted RIFC chairman David Somers approached the Take Over Panel.

He was convinced that Mr King had acted in concert with several others.

If this was true then they could be compelled to make an offer for the rest of the RIFC shares.

You know the rest.

At the time Mr Somers was derided by the Stenography Corps who were in the tank for Mr King.

They were salivating at the idea of the convicted criminal taking over at Ibrox.

Somers warned what would happen if King and his concert party took over.

However, the Off Licence Putsch was successful in March 2015 which has led us to this juncture today.

Mr King has been playing for time with the Take Over Panel in much the same way as he played a delaying game with SARS.

Ultimately he ran out of road with the tax authorities in South Africa.

Once more, for the avoidance of doubt, anyone who does not think that the Take Over Panel are serious about going after Mr King has not been paying attention.

  2. So now we have a reply and the dumby has been spat out!
    According to the BBC, Dave King has told them that he sees a move by the “TP”to initiate contempt of court ruling against him as “Bullying”!

    So it is okay for him to make moves and hound someone out of office for comments they made years ago and outwith office!
    High time the SFA grew a pair (or get an old pair from Wimbledon) and sorted this guy out once and for all.
    We have gone past the “bringing the game into disrepute” not only in Scotland but now worldwide.
    Who wants to be associated with this mess called Scottish football?

  3. Can this, even at this late date, somehow impact on the Euro License? I ask this because I simply don’t know. Can it somehow be classed as a debt that has a bearing on FFP rules? Anyone out there have any knowledge in this area?

  4. At this pace, it will take many months before King is held to account. By then, expect others at Ibrox to be doing walking away, quite sharpish, for fear of a cold-shouldering. Premier clubs, indeed anyone doing business with DCK should take note. At this point in time, he does not appear to be a healthy addition to your credit score, more like a walking liability, IMHO.

    • Posted this before that as South African citizen the Top can’t touch him personally unless he comes back to castlemilk lol. However as one chap, am fae leith so a know a few gadgies, has said that it’s now not a civil case because contempt is a criminal offence will an international warrant be issued for said daveman?

  5. Over on Ibrox noise (what do empty vessels make) there is piece which describes Dave King as being in a “spot of bother”.

    It goes on to say that he “apparently hasn’t purchased the sharessential he was instructed to”. Yes, apparently!

    It finishes off by saying, “it’s all a bit complicated. Hopefully it will all be sorted out soon”.

Thanks Phil, again, for bringing an important document to the fore, and for pointing out the determination of the TOP in paras 18-24 to demonstrate due process, and avoid any more obfuscation on the part of the GASL. Great reading, and I’m sure there is much more to come. Whilst this may appear like a long, drawn out process, it’s very intriguing to watch, and will be all the more enjoyable to peruse over once the inevitable conclusion is reached.

  9. Phil; I’m a little confused as to what the TOP can actually do to King. At the ruling from the Court of Session he basically thumbed his nose at them and the court by stating that he had no banking facilities and no listed assets in UK that can affect him.

    Do you know if this “cold shoulder” could force the removal of King from the board? Could it really force other companies to not do business with them? I’m not sure they have the remit to be able to do harm to a legal business and forcing someone like, say, Metrobank to dump them could be argued that it causes the club economic harm.

    Any chance you could get Rugger guy or one of your other sources to lay out what type of sanctions can be applied to King specifically other than an arrest warrant if he steps foot in UK?

    • King owns a large number of shares in a football club playing out of Ibrox, and the right of repayment to a rather substantial loan he’s made to that club. Were the Courts to fine him for contempt, they could then freeze those assets, call in the loan and attempt to find a buyer for the shares (don’t laugh). The TAB may be playing gently to protect the minor shareholders in Rangers, the courts are under no such obligation.

  11. Once again The Lying King has asked for a review panel trying to boot this down the road. How stupid does the justice system have to be, to allow this charlatan to play the system so much? Just haul him in and send him down NOTHING else will do.

  12. Good to see that COS/TOP have got the measure of King.
    The part in the statement casting aspersions on King’s knowledge of SA exchange rules is telling.
    Anyone doing business in the UK with links to King do so at their own risk.
    Metro Bank, accountants, solicitors etc.
    Close Bros may be looking at the small print in their loan agreement.
    After all February is a long time away.
    It’s crystal clear that King has no intention of complying with COS/TOP orders. His concert party mates must be wondering if they will be next to get a chap on the door from them.
    Oh and still no word as to who will be selling the new kit.
    Is there another lump sum payment due to SD before they finally let go?

    Enter one of the screws, “Hey Mr King, the Governor wants a piece of the action”

  15. It’ll be interesting to see what steps the courts take next, because while they can imprison King for contempt, they can also fine him. Were he not to pay such a fine, they could then in theory start confiscating and selling off all his accessible assets. And at present I estimate those assets to be a shareholding in a large football club down Govan way, and a very large loan made to said club.

    • It’s interesting that Alasdair Lamont of the BBC refers to the case as a feud, as in, “The feud between Dave King and the Takeover Panel has escalated“. You’d think this was just 2 neighbours arguing over a fence.

        ie , “don’t shoot me! I’m just reporting it” and “just a financial formality to be overcome”

      • Why is a sports journalist given the job of reporting on these legal and financial matters? It seems the BBC have, since the very start of this saga, kept the story well away from the journalists who are more qualified in the subject matter. Likewise they give the SFA a free pass, never doorstepping the footballing authorities for comment. Like most MSM they prefer to wait for a press statement they can cut and paste.

      • I noticed that immediately. It seems to me to be a way of giving validity to Dave King’s position.

        This is not a feud, or even a dispute. This is a refusal to comply with the law of the land, which in my book makes it criminal activity.

        A responsible journalist knows this and by pointing out the long list of criminal activities of Mr King in the past, it would lend credence to any speculative opinion the journalist may inadvertently provide – I say inadvertently because journalists should stick to the facts. Funny there is no mention of past misdeeds.

        Is Dave King even the Rangers chairman? Is he not the Chairman of the holding company which owns the limited company which owns the football club or some similar nonsense? I’m sure this is what will be claimed when the proverbial well and truly hits the fan.

        The BBC piece is what I call a cut-and-paste-apologist-puff piece.

        That is was reported by James Forrest before the BBC speaks volumes for the BBC – just as the new third strip speaks volumes for the football team playing out of Ibrox.

  18. I take it from your third sentence you have just finished watching Guy Ritchie’s brilliant film “Snatch” or was it “Lock, Stock…”
    Anyway, regarding your “toddler”comment and as one who has commented on TOP’s inordinately long time to do nothing, I am never going to play you again, ever!
    I will say this though, don’t you find it ironic that it was a month ago and nobody knew about it. Somebody should tell DK. Then again what you don’t know doesn’t hurt you.
    Just like to say, regarding the ridiculous accusations thrown your way recently by people who should know better, it reminded me of FDR’s request to judge him ” by the enemies he made”.
    Speaking of toddlers, I would suggest a certain blogger should write a book on the grotesque subject of
    a missing one that he seems so obsessed with and cease demeaning the whole thing by publishing nasty, little pay-for-view opinions on the matter. It would give the theory credence and if valid, a public airing.

  24. The late-lamented ( Broxwise ) Mr Somers was one of the few Sevco actors competent to the role in which he found himself cast.

    His engagement with reality and truth meant he was not popular with Ra Peepul.

    Observers with good memories will recall that he publicly knocked back the King consortium’s offer in 2014. Their bid failed, according to him “at stage one” – the two stated key points of failure being
    1) Failure to provide proof of funds
    and
    2) Failure to specify the identities of five of the (supposed) eight in the consortium

    Point (1) will of course sound very familiar to today’s audiences. Mr Dave “Failure-to-provide-proof-of-funds” King is a well-known character by now.

    And the secrecy over the other members of the consortium, we might well speculate, was designed to avert unwelcome attention at a later date, should they proceed to buy in as a concert party. TRIH.

    As for the Takeover Panel, I am very much on board with Phil’s expectations. Their mills grind slowly; but carefully, and exceeding small. They are not used to being challenged, and will no doubt have argued to both the outer and inner courts that it is very much in the public interest for their decisions to be enforced and seen to be effective. In the same way that the tax authorities – having bigger fish to fry – could not afford for Rangers (RIP) to get away with their financial turpitude, so the PTM can’t afford for King to be seen to give them the finger with impunity. “Pour encourager les autres, ” as the saying goes.

    He’s already been served for contempt. And with the PTM attentively working the tables, it won’t be the last serving he gets, rest assured. ; )

  25. Does this mean that Mr King will be arrested the moment his feet touch UK soil ? Assuming that he ever comes back again!

    He will need to be keeping a ‘wary eye’ on things if he does come back to experience those great euro nights in Govania…

    … Mind you ! He is well practised in looking over his shoulder. So well practised in fact, that he can look over both shoulders at the same time.

  26. Was reading through some legal documents and Mr DK is looking at a max 3 months for contempt.

    This isn’t a civil case where his wheeling and dealing will get him away with it. Contempt of court is a criminal offence not taken lightly by our Sheriff’s

    • I read it as a maximum of TWO years.

      He is in contempt of a Supreme Court order (2 years) rather than a sheriff court (3 months) or a district court (60 days) order.

    • I believe that he will remain ‘in contempt’ also until the issue leading to this is addressed…

      How is he going to get out with the cash without being picked up in the uk.

      Everybody, from SFA, SPFL, police Scotland, media (especially) and even UEFA are going to be shown up for what they are when this goes ‘critical mass’.

  29. I wonder if Mr Maxwell at the SFA has anything to say about King’s contempt charge.
    Don’t hold your breath as to date the SFA has stood by and let the convicted criminal act as a shadow director of the football club and at the same time make all sorts of accusations concerning SFA and SPFL officials.
    So he’s in contempt of a court order, what next?
    Has TOP effectively suspended shares in the club/company/thingy thus preventing the share issue mooted by King?
    Why has it taken nearly 4 weeks for this info to become public?

    • There are shares to suspend as they are not listed. That is one of the reasons King has cocked his snoot at the TOP and Court. He stated he has as much as stated that here is nothing they can do to him finance wise. Possibly true, but if I were him I might skip coming up to Ibrox for their glamorous Europa League match.

  31. The basic premise being the TOP cannot be seen to allow this lying cheating scumbag of the hook, he has to comply or face imprisonment. This is a first for the TOP, no one has ever taken them this far. All in the city are watching.

    • It leads to an interesting question though. What can they really do to him unless he comes to UK?

      I don’t believe they have the power to seize his shares nor can they do anything to the actual business that is RIFC. They could perhaps force him to be removed as Chairman by barring him from any role in a UK company, but he could pass his shares to a proxy and still be running it from afar. Interesting times ahead, not just for him but also the SFA if they do ban him.

      • The TOP can’t seize his shares, but if the courtsd find him n contempt then they can fine him and send in the sheriffs officers to seize any assets they can find in order to pay off that fine. They can also recommend that he be struck off as a director. And none of that lets him off having to make the offer to buy the shares. It’s just extra expense.

    • Not so much downplayed, as silenced at birth! If they were to print the truth of this ensuing story, they would witness six years of lies being undone – the “same club” argument would be shot to pieces, and they would be held up to ridicule by their peers. What we are witnessing is the 21st century domino theory being slowly played out before our very eyes.
